Wrongful Death

It is truly tragic when someone else's negligent, careless, reckless, or intentional act causes the death of a loved one. Colorado law provides for wrongful death and survival actions in order to protect certain family members in these terribly unfortunate situations.
A wrongful death action alleges that the surviving dependents or beneficiaries are entitled to monetary damages as a result of the defendant's fatal conduct. The amount of money that may be recovered through a wrongful death lawsuit includes the monetary loss suffered by the family members who are now deprived of the decedent's earnings. Family members and beneficiaries may also recover money damages for medical and hospital bills, nursing-home costs, funeral and estate administration expenses, and prospect of inheritance.
In addition to damages for wrongful death, the decedent’s family members and beneficiaries may be able to recover damages for the personal injury suffered by the decedent. These are called "survival actions," as the personal injury action survives the decedent. In a survival action, the decedent’s personal representative brings the lawsuit for the benefit of decedent’s estate. The degree of consciousness, severity of pain, apprehension of pending death, and the duration of suffering are just some of the factors that account for damages.
